When You Sue or Are Sued -- Litigation

"Litigation" is another word for lawsuits. When disputes cannot be settled, suits often have to be prosecuted or defended. We can advise you of your legal rights and obligations, the merits of your case, and the likelihood of a favorable result to you. We will review with you in advance the expected legal costs of the proceeding, so that you can evaluate the prospects of both settlement and litigation. You may have heard the saying that "a lawyer who represents himself has a fool for a client." Except in small cases where the cost may be too great, a client who represents himself may regret that choice later on.

We are experienced in a number of litigation areas. Those include:

  • Real Estate litigation such as suits for improper concealment of defects, partition and accounting, specific performance, defaults on real estate contracts, construction disputes, slander of title, and even watercourse rights.
  • Disputes regarding trusts, breaches of fiduciary duty, tortious interference with inheritance, declaratory judgment, and other matters in the "Chancery" Courts. ("Chancery" courts deal with cases seeking relief other than money.)
  • Breach of contract cases and other miscellaneous civil litigation.
